Rapper Jay-Z faces a sexual assault lawsuit, but his legal team filed a letter asking the judge to dismiss the case on technicalities
Jay-Z’s team is looking to dodge a r@pe lawsuit brought against him by calling on a loophole.
The civil lawsuit was brought against the rapper by an anonymous woman who alleged, when she was 13 years old, she was assaulted by Jay-Z and Sean ‘P. Diddy’ Combs after the 2000 MTV Video Music Awards. However, Jay-Z’s lawyer, according to a letter to the judge obtained by The Mirror, is asking the court to dismiss the case.
Alex Spiro, celebrity lawyer, claimed timing was an issue in the woman’s lawsuit. After all, her allegations were made under the Victims of Gender-Motivated Violence Protection Act (the “GMV Law”), but, as Spiro claimed, “the statute does not have retroactive effect.” The law was enacted on Dec. 19, 2000, but the alleged incident would have occurred three months prior.
Moreover, Spiro took issue with the alleged location, noting that the law is only applicable if the alleged incident occurred in New York City. While the Jane Doe claimed she attended the VMAs at Radio City Music Hall, she also claimed the alleged assault occurred at a second location. She claimed she was driven 20 minutes away to “large white residence with a gated U-shaped driveway,” according to her complaint obtained by The Mirror.

Spiro claimed that, after reviewing public records, “any such residence— to the extent it existed at the time—would have been located outside the territorial boundaries of New York City.” Finally, Spiro argued that the statute of limitations barred the Plaintiff’s ability to file the suit as the alleged incident would have occurred 20 years ago.
Previously, a revival period was put into place to temporarily lift the statute of limitations in an effort to allow survivors a chance to come forward. However, “that period expired in August 2021,” according to Spiro. The letter claimed: “Plaintiff seeks to plead around this statute of limitations issue by asserting a claim under the GMV Law, which contains a longer revival period. Courts in this District, however, have recognized that the CVA’s revival period preempts the GMV Law’s overlapping and extended one.”
Jay-Z denied the allegations against him in a lengthy statement. He wrote: “These allegations are so heinous in nature that I implore you to file a criminal complaint, not a civil one! Whomever would commit such a crime against a minor should be locked away, would you not agree? “These alleged victims would deserve real justice if that were the case.”
He added: “My only heartbreak is for my family. My wife and I will have to sit our children down, one of whom is at the age where her friends will surely see the press and ask questions about the nature of these claims, and explain the cruelty and greed of people. I mourn yet another loss of innocence. Children should not have to endure such at their young age. It is unfair to have to try to understand inexplicable degrees of malice meant to destroy families and human spirit.”
Diddy continues to deny all allegations of wrongdoing against him.
